James practices business law and handles all aspects of trusts and estates. With more than 20 years of experience, James joined Duckor Metzger & Wynne in 2022 to help the firm expand its Estate Planning, Trust Administration & Probate practice. Previously, he was a shareholder at Boner Stern & Sipple.
Business Law
In his business law practice, James assists clients through all phases of the business life cycle, including the selection and formation of business entities, general business matters, and succession planning. He has substantial experience in negotiating and preparing buy-sell agreements, stock purchase agreements, asset purchase agreements, contracts, and leases, and handles all aspects of real estate transactions. He also advises companies on corporate governance matters.
Trusts and Estates
James advises clients in developing and implementing comprehensive estate plans and provides guidance on more advanced tax planning strategies for larger estates that are estate tax sensitive. As large estates are often comprised of substantial real property and business interests, James’ business and tax background offers synergistic planning opportunities to clients. He also advises clients in the administration of trusts after the passing of the trustor(s). When disputes arise, he represents clients through the litigation process, including trustees and beneficiaries. In addition, he represents clients through many different types of probate court proceedings including probate administration, general conservatorships, limited conservatorships and guardianships, and various types of petitions relating to trusts.
As community property laws are an integral part of the estate planning and trust administration process, James advises clients regarding issues relating to the character of property under California law. Additionally, he assists clients regarding agreements to clarify and/or modify property rights including pre-marital agreements, post-marital agreements, and co-habitation agreements.
